Family Law Decisions

Trauma-informed expert witness assessments that maintain strict neutrality and professional rigour.

Delivering actionable insights to support fair and evidence based court outcomes.

What We Provide

Child Trauma Consultancy provides independent expert witness reports for the Family Court of Australia and other courts.

These reports offer trauma-informed assessments that assist courts and legal professionals in understanding complex family dynamics, behavioural presentations and the impact of trauma on individuals and family systems.

Our assessments are designed to translate complex behaviour into clear, evidence based insights that support informed decision-making in important legal proceedings.

Our Approach

Every assessment is conducted with strict independence and impartiality.

Our methodology is grounded in accepted social work and trauma practice standards, drawing on established research frameworks in trauma, family violence, coercive control and child development.
Reports are structured to provide the court with a clear analysis of observable patterns, their consistency with established research literature, and their implications for the matters at hand.

We do not make findings regarding disputed facts or assign credibility. We provide context, analysis and professional insight that helps legal professionals and courts navigate complex presentations with confidence.

Our approach is rigorous, evidence-based and maintains neutrality throughout.

At the same time, our reports remain informed by trauma knowledge, ensuring that behavioural presentations are understood within appropriate developmental and psychological frameworks.

What Our Reports Cover

Our expert witness reports can address a range of matters relevant to Family Law and other proceedings, including trauma-informed analysis of family violence documentation, patterns of coercive control and their impact on decision-making and functioning, trauma response indicators and their implications for parenting capacity and wellbeing, property adjustment matters where trauma and financial abuse intersect, and the impact of complex trauma on children’s developmental needs and best interests.

Each report is grounded in current research literature and referenced to accepted professional standards, ensuring findings are clear, balanced and defensible.

Case Studies

The following case studies illustrate the types of analysis Child Trauma Consultancy provides.

All names used are fictional and do not represent real individuals.

These examples demonstrate our methodology and the practical value our reports offer to courts and legal professionals.

Case Study 1:
Family Violence Analysis

Matter type Family violence claim in the context of family law property proceedings Analysis scope: Patterns of family violence across physical, sexual, emotional, psychological and financial domains; trauma response indicators

In this matter, documentation outlined a party’s family violence allegations spanning multiple years.

The analysis applied trauma informed principles to identify patterns consistent with established research on intimate partner violence, drawing on frameworks including Johnson’s typology of intimate partner violence, Stark’s work on coercive control, Herman’s research on complex trauma and trauma bonding, and Bancroft’s analysis of the characteristics of abusive partners.

The report identified escalating patterns of physical violence, patterns of sexual coercion involving manufactured consent frameworks, and systematic undermining of the party’s credibility through characterisations such as ‘controlling’ and ‘unstable.’

Each pattern was mapped against the relevant research literature, providing the court with a clear framework for understanding the dynamics described in the evidence.

The analysis maintained a neutral stance throughout, describing observable patterns and their consistency with research without making findings regarding disputed facts or assigning credibility.

Case Study 2:
Property Adjustment and Financial Abuse

Matter type
Property adjustment in family law proceedings

Analysis scope:
Patterns of coercive control and economic abuse; trauma responses in property settlement context

In this matter, documentation addressed property adjustment where allegations of financial abuse were relevant.

The analysis identified patterns consistent with economic abuse as described in established research, including manipulation of financial contributions, alteration of shared financial records, and post-separation financial reality distortion.

The report also examined how trauma responses affected the party’s capacity to assert their financial interests during settlement negotiations.

Drawing on Herman’s work on internalised subjugation and Walker’s research on trauma bonding, the analysis provided context for understanding why a party may repeatedly minimise their own legitimate claims or modify positions downward in response to the other party’s emotional reactions.

This type of analysis helps courts and legal professionals understand how trauma can influence behaviour during proceedings, ensuring that presentations are assessed within appropriate psychological frameworks rather than at face value alone.

Engagement Process

Expert witness engagements typically begin with an initial consultation to discuss the nature of the matter, the scope of the assessment required and the relevant documentation.

Following this, we review the materials, conduct our analysis and prepare a comprehensive report within agreed timeframes.

We work with legal professionals to ensure our reports address the specific questions before the court and meet the standards expected of expert evidence.
